These Terms of Use will apply to your access and use of the services offered by Fletes USA through its website and associated platforms. However, they will not apply to the overall functionality of the website or individual policies of third parties. Fletes USA may collect information directly from you, from third parties such as service providers and publicly accessible sources, or automatically through your interaction with and use of the Fletes USA Sites.

Fletes USA may use the information collected in many ways, including, but not limited to: (i) providing you with the products and services you request; (ii) operate, improve and analyze Fretes USA products, services and Sites; (iii) provide and improve Fletes USA customer service for customers, carriers, job seekers, service providers and other suppliers; (iv) communicate with you, including regarding your use of our products, services and USA Freight Sites, and personalize your use of the USA Freight Sites; (v) provide transportation and shipping information (such as origin and destination locations, shipping status and location) and other information related to the provision of logistics services (such as information for customs clearance or security purposes) to customers, carriers and other third parties (including government entities) in connection with the performance of transportation or logistics services; (vi) provide legal and administrative notices; (vii) contact you regarding employment/potential employment, whether via telephone calls, emails or text/SMS messages; (viii) promote safety; (ix) protect against the identification and prevention of fraud and other prohibited or illegal activities, claims and other liabilities; (x) comply with applicable laws and regulations; (xi) collect payments for Fletes USA products and services (including obtaining government-issued identifying information as necessary or required by law); (xii) verify the identity of the people with whom Fletes USA communicates or does business; (xiii) facilitate the recruitment process, including determining qualifications for hire and making hiring decisions, and keeping potential job applicants informed of future roles; (xiv) make payments; (xv) advance other purposes disclosed to you through the Fletes USA Sites or Fletes USA marketing, presentations or literature; (xvi) allow and/or facilitate internal employee communication and other employment uses; (xvii) allow and/or facilitate direct communication with carriers and other third-party service providers that perform transportation or logistics services; (xviii) for Fletes USA marketing purposes; (xix) communicate with you about promotions, contests, events, surveys, seminars.
Text and SMS messages
At Fletes USA, we communicate via text message or SMS in two distinct programs: (1) with prospective employees, including the use of third-party service providers (the “Potential Employment Program”), and ( 2) with independently contracted motor carriers, including the use of third party service providers with the Potential Employment Program, the “Program”). The Program allows users to receive mobile messages based on the mobile contact information provided: directly to Fletes USA in the case of the Program or directly to Fletes USA, our third party partners or to (or from) other third parties in connection with marketing opportunities. potential employment, in the case of the Potential Employment Program.
This Privacy and Cookies Policy applies to your participation in the Program, and by participating in the Program: you agree, in connection with the Potential Employment Program (relating to potential employment opportunities), to receive mobile messages from Fletes USA , including from any third party partner who communicates with you on behalf of Fletes USA, including, without limitation, messages via text/SMS and/or pre-recorded or self-dialed marketing mobile messages, at the telephone number you have provided or at the telephone number that someone may have provided on your behalf after determining your potential interest in employment with Fletes USA, in connection with potential employment opportunities with Fletes USA; you agree to receive mobile messages from Fletes USA via text/SMS at the telephone number you have provided, in connection with your business or potential business with Fletes USA; and you understand that no purchase is necessary to use the Program.
Although you may consent to receive messages sent using an autodialer, the foregoing should not be construed to suggest or imply that all of our mobile messages are sent using an automatic telephone dialing system (“ATDS” or “autodialer” ). Messages can be in the form of short code texts, which is a 5 or 6 digit phone number used by businesses to send and receive text messages on a large scale.
If you no longer wish to participate in the respective Program or no longer accept this Privacy and Cookies Policy, you agree to reply “STOP” to any mobile message sent as part of the respective Program to unsubscribe from the respective Program with respect to messages from the associated telephone number used on our behalf for communications (“associated telephone number”). You may receive an additional mobile message confirming your decision to unsubscribe, and we will attempt to remove you from our contact list for the telephone number associated for this purpose within fourteen (14) days. If you re-enroll in the respective Program in connection with the associated telephone number after replying “STOP”, we will continue to send messages from the associated telephone number to the telephone number associated with your registration (with your participation in the Program again subject to this Privacy and Cookies Policy). You understand and agree that the above options are the only reasonable methods for unsubscribing. You also understand and agree that any other method of unsubscribing, including, but not limited to, sending words other than those mentioned above or verbally requesting one of our employees or one of our third-party service providers to remove you from our list , is not a reasonable means to unsubscribe.

YOU AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS Fletes USA, our agents and any third party service providers we use to send text messages, from any claim or liability arising from your failure to notify us of a change in information you have proportioned. This includes, but is not limited to, any claim or liability under the Telephone Consumer Protection Act, 47 U.S.C. § 227, and similar federal and state laws, as well as any regulations promulgated thereunder, that may arise from our attempts to contact you at the mobile telephone number you have provided.

Fletes USA operates its platform, in whole or in part, in the United States. By using our services, you agree to have your personal data stored, processed and transferred to the United States, and allow Fletes USA to use and collect your information in accordance with this Privacy and Cookies Policy, and in accordance with laws and regulations. that apply in the United States.
